1. Agreement Overview

By booking, purchasing, or engaging in any service provided by Mobile Photo Lab™, the client (“Client”) agrees to the following Terms and Conditions. These terms are designed to ensure clarity, professionalism, and mutual respect while protecting the creative and operational interests of Mobile Photo Lab™.

2. Payment & Booking

A non-refundable retainer or deposit is required to confirm all bookings.
Remaining balances are due by or before the day of the session or event unless otherwise stated in writing.
Failure to make full payment may result in cancellation, delay of deliverables, or withholding of final images.
Prices are subject to change without notice; however, confirmed bookings will be honored at the agreed-upon rate.

3. Cancellation & Rescheduling

Cancellations made less than 72 hours before the scheduled session may result in forfeiture of the deposit.
Reschedules are permitted once per booking, subject to photographer availability.
In the event of illness, weather, or equipment failure, Mobile Photo Lab™ reserves the right to reschedule or substitute an equally qualified photographer.

4. No Return & Refund Policy

All sales are final. Photography is a time-based creative service; once services have been rendered or files delivered, no refunds or returns will be issued.
At the sole discretion of the photographer, reasonable accommodations (such as limited reshoots or service credits) may be made in extraordinary circumstances.

5. Image Delivery & Retention

Images are typically delivered within the agreed timeframe following the session or event.
Client galleries remain accessible for 30 days from delivery unless otherwise specified.
Mobile Photo Lab™ may archive images for internal use but is not responsible for long-term storage beyond 60 days.

6. Usage Rights & Copyright

All images remain the copyright and intellectual property of Mobile Photo Lab™, protected under U.S. Copyright Law.
The Client receives a limited personal or commercial license (as agreed) to use the final, edited images for personal or promotional use.
Raw or unedited files are not provided unless stated in a separate written agreement.
Re-editing, altering, or selling images without written consent is prohibited.

7. Model Release & Publicity

By participating in a photo session or event, the Client grants Mobile Photo Lab™ the right to use images for portfolio, marketing, advertising, and promotional purposes — both online and in print — unless the Client explicitly declines in writing prior to the session.
Clients in sponsored or public events acknowledge that their likeness may appear on prints, folders, or digital galleries with event or sponsor branding.

8. Client Responsibilities

The Client agrees to:

Arrive on time and prepared for the session.
Follow photographer instructions to ensure the best results.
Obtain necessary permissions for photography at private locations or with minors.
Mobile Photo Lab™ is not liable for limited coverage due to lateness, uncooperative subjects, or restrictions imposed by venues.

9. Limitation of Liability

In the unlikely event of technical failure, injury, loss, or unforeseen circumstances, Mobile Photo Lab™’s liability shall be limited to the amount paid by the Client for the affected service.
Mobile Photo Lab™ is not responsible for incidental, indirect, or consequential damages arising from its services.

10. Privacy & Data Protection

Mobile Photo Lab™ respects all clients’ privacy. Personal information and images are handled securely and never sold or shared with third parties outside the normal course of business (e.g., gallery hosting, printing vendors, sponsors, or app integrations).
Clients may request removal of their images from public galleries or marketing materials at any time by contacting MrDear@MobilePhotoLab.com.
Data is stored in compliance with applicable privacy laws.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes arising from this agreement shall be resolved through arbitration or mediation before legal action is pursued.

12. Acceptance of Terms

By booking, paying, or participating in any Mobile Photo Lab™ service, the Client acknowledges they have read, understood, and agreed to all Terms and Conditions stated herein.
